The PA Department of Health’s mask mandate is the subject of hearings that started yesterday in Commonwealth Court.
At issue is the mask mandate that was issued August 31st that declared students, staff and faculty have to wear a mask when going into a school building unless they are able to produce a medical reason why they cannot wear a face covering. On Wednesday, a panel of judges heard arguments on the mask mandate lawsuit. Those against the mandate said that Acting PA Health Secretary Alison Beam did not have the authority to issue the mask mandate. Two lawsuits have been filed by parents who contend that masks interfere with a child’s breathing among other problems, and that Beam’s mandate was, in their opinion, a regulation that should have been properly vetted in a regulatory review process. The plaintiffs include the President Pro Tempore of the Senate, Jake Corman of Centre County.
What is not at question is whether or not masks prevent the spread of Covid-19 among children.
There’s no word yet on when a decision on this matter is expected to come out.
