A Pennsylvania Commonwealth Court judge said on Tuesday that the order that requires masks in K-12 schools must expire on December 4th.
The ruling from Commonwealth Court Judge Chrstine Fizzano Cannon comes one week after the court declared that the mandate put in place by Acting PA Health Secretary Alison Beam was not allowed under state law, as she did not have the authority to issue a statewide mandate, and the state never created a regulation under the state’s disease control law to allow it. Two days before that announcement, Governor Tom Wolf announced that the mask mandate would expire on January 17th for K-12 schools, but would remain in place for child care centers and early learning programs.
The state supreme court will still get to hear the appeal from the Wolf Administration, but in theory, the new end date will give the court time to hear the case or for the administration to enact a mask mandate through an emergency order.
