State Representative Jim Struzzi is putting a bill forward to help those in Pennsylvania who have a tax problem after having lost a loved one.
The problem came up in recent discussions with a local resident who lost an adult child. In the process of settling their estate, they discovered that the deceased had overpaid their Personal Income Tax and was owed a refund. On the federal level, that can be easily fixed with a 1310 for claiming the refund, but in Pennsylvania, it is not that easy.
House Bill 1921 would permit the PA Department of Revenue to craft a form that would issue a refund to the executor, administrator or other personal representative of the deceased where the will is not present. In this case, the representative would need to complete the form and bring it with the death certificate and proper documentation confirming the relationship to the deceased to get the refund.
Struzzi calls it the “simplification of a process that presently is exhaustive for a grieving family.” He also said that this was a prime example of why citizens should come forward with suggestions for bills, no matter how trivial they may seem.
