During the Indiana Borough Council Meeting last night, council approved a settlement agreement that has brought an end to a long-standing legal dispute over unpaid money to the former Downtown Indiana Business Improvement District.
The lawsuit has been going on for over six years, and a settlement was reached in late July. The settlement was formally approved by borough council last night. Borough solicitor Neva Stotler said that it was a zero-dollar settlement. With the BID expiring and no new BID in place, all parties decided to walk away from the lawsuit.
The litigation started in 2012 when the legal representatives of the Susan S. Delaney Revocable Trust alleged that there was a “misuse of governmental and statutory authority” over the Downtown Indiana Business Improvement District and being forced to pay an “assessment” to support the BID while others did not have to pay that BID assessment. The BID expired in 2016, and a similar project called the IDIA was rejected by business owners in 2017.
