The parents of a state trooper who died last year in a collision between his cruiser and a garbage truck have filed a lawsuit for wrongful death.
Michael Stewart Jr. and Lynn Stewart name McInchok Sanitation and driver John Hissem Jr. in the suit, which seeks unspecified damages for the death of Trooper Michael Stewart III at 2:20 AM on July 14th last year on Route 711 near the Sheetz store in Ligonier Township.
A police investigation placed the blame for the crash on Stewart, contending that speed, fog, a wet road and poor sight line were the key factors. But the lawsuit claims that the driver of the truck, Hissem, was careless and inattentive, saying that the accident was “a direct result of (his) negligence, carelessness, and recklessness”.
Stewart’s passenger, Trooper Travis November, filed suit against the trash hauler last year, but last month it was withdrawn without prejudice.
Trooper Stewart was an IUP graduate.
