Nicholas Corsetti, the attorney for Brady Distefano, last week filed a letter arguing his client’s position that a dismissed homicide charge against him should not be reinstated. The State Superior Court now lists the case as “awaiting consideration.”
DiStefano, who is now 21 years old and is from Johnstown, was charged with killing his IUP frat brother, 20-year-old Caleb Zweig of Rockville, Maryland, in February of 2017. The two young men were involved in a fight and a bystander pulled DiStefano off Zweig as he sat astride him, choking him. Zweig later died at the Indiana Regional Medical Center.
Judge William Martin dismissed the charges last November, ruling that the prosecution had not presented sufficient evidence to justify continuing the case. District Attorney Pat Dougherty was prepared to pursue a conviction for third degree murder. Dougherty appealed and the slow-moving case has been making its way through Superior Court. Assistant D.A.
