An update on a story we brought to you yesterday in the Brady DiStefano case. The State Superior Court yesterday granted a request for an extension for the Indiana County District Attorney’s office to file a brief in support of its appeal of the dismissal of charges against DiStefano in the strangulation death of a fellow IUP fraternity member last February.
The D.A. is appealing Judge William Martin’s decision to drop the case against DiStefano, who fought with 20-year-old Caleb Zweig of Rockville, Maryland, in the 800 block of Wayne Avenue. Zweig died early the next morning at the Indiana Regional Medical Center. A witness described for investigators how he pulled DiStefano off Zweig as he was choking him. D.A. Pat Dougherty was going to see a conviction for third degree murder, but Judge Martin ruled that he had not presented sufficient evidence to justify continuing the prosecution.
Yesterday’s ruling by Superior Court extends the deadline for the brief to March 22nd.
