Indiana County District Attorney Pat Dougherty has a deadline today to file a brief in support of his appeal in the Brady DiStefano case.
Dougherty is appealing Judge William Martin’s decision to drop the charges against DiStefano, who was 19 years old when he fought with fellow IUP fraternity brother Caleb Zweig last February. The 20-year-old Zweig, who was from Rockville, Maryland, died early the next morning at the Indiana Regional Medical Center. DiStefano was charged with criminal homicide and aggravated assault, but in November, Judge Martin ruled that the D.A. had not presented sufficient evidence to justify continuing the case. Dougherty was preparing to seek a conviction for third degree murder.
The brief in support of the appeal must be filed no later than today with State Superior Court. Assistant D.A. Gina Ryen Force is representing the District Attorney for the appeal.
