Richard McAnulty is running out of chances to get his conviction overturned for the murder of a Southwest Greensburg man seven years ago. Westmoreland County Judge Richard McCormick Jr. has rejected McAnulty’s petition for post conviction relief.
The 61-year-old McAnulty shot 39-year-old Harry Mears III in July of 2010. Mears and McAnulty’s wife had been involved in an extramarital affair that had ended months before, but McAnulty had discovered emails between the two and became enraged, driving thirty miles to Mears’ home to kill him.
Last summer, Judge McCormick reopened the case and allowed McAnulty to review the transcript of the trial. McAnulty claimed his original attorney botched the defense and that Judge Debra Pezze should have not allowed Diane McAnulty to testimony about the emails. Judge Pezze passed away last year.
In his order denying the petition for post conviction relief, Judge McCormick gave McAnulty thirty days to appeal to State Superior Court.
