For a third time, the attorney for Kevin Murphy has been given a 120-day extension to file a motion for post conviction collateral relief in his conviction for the murders of his sister, mother, and aunt in April of 2009.
Murphy, who is 56 years old and from Saltsburg, is seeking a court review of his conviction, contending that his attorneys did not effectively defend him during his 2013 trial. Last November, his death warrant was signed by state Corrections Secretary John Wetzel. That same month, a new attorney was appointed for him and a second attorney was added in January. In July, his attorneys asked for access to the physical evidence and trial exhibits, including the .22 caliber revolver used to shoot the three victims at the family’s glass shop in Loyalhanna Township, Westmoreland County. Prosecutors said he killed the women because they objected to his relationship with a married woman.
The state Supreme Court last year dismissed Murphy’s appeals of both his conviction and his death sentence.
On November 6th, Judge Megan Bilik-Defazio granted the latest request for a 120-day extension on the motion for relief.
