SENTENCING TODAY INCLUDES DEFENDANT IN FIVE CASES, METH LAB OPERATOR

UPDATE: Brian James Barr was ordered to serve 11 and a half months to a day less than two years in county jail and three years of parole for three felony counts of theft and for criminal trespass, and nine months to a day less than two years in county jail for a misdemeanor count of receiving stolen property.  All the prison sentences will run concurrently and the probation sentences will also run concurrent with each other.  Barr also had his probation revoked in another case of retail theft and was sentenced to 10 months to a day less than two years in county jail.

Ted Rorabaugh was ordered to serve one year of probation on the possession charges and 11 and a half months to a day less than two years in county jail for the other charges.

Donald Lee Kosek, Jr. was placed in Indiana County Jail for 72 hours to six months for the DUI charge and 6-18 months for the firearm violation, with the jail terms to run concurrently.  He will also serve two years of probation.

WHAT WE PREVIOUSLY REPORTED

In Indiana County Court today, a number of defendants are scheduled for sentencing, including one who pleaded guilty in five separate cases.

45-year-old Brian James Barr of Commodore pleaded guilty but mentally ill to a combined total of five offenses: three counts of felony theft, one count of felony criminal trespass entering a structure, and one misdemeanor count of receiving stolen property.  Barr’s crimes occurred between March 31^st and April 6^th of last year.  He pleaded guilty in January.

43-year-old Ted Allen Rohrabaugh of Brush Valley Township will be sentenced in two cases, for felony guilty pleas to operating a methamphetamine lab and manufacture, delivery or possession with intent to deliver; and to misdemeanor possession of a controlled substance and possession of drug paraphernalia.

Rohrabaugh was charged after police investigating a stolen motorcycle license plate at his home smelled a strong odor of marijuana and he eventually admitted he had marijuana plants growing in his home along Pine Valley Road.  Police found fifty plants, and after further investigation turned up purchases of chemicals used in meth manufacturing, they returned and found the meth lab operation.

Also on the sentencing schedule today are 55-year-old Donald Lee Kosek of Home, for misdemeanor prohibited possession of a firearm; 63-year-old Michael Joseph Braden of Cherry Tree, for terroristic threats; and 30-year-old Nicole Marie Windows of Indiana will be sentenced for DUI (fourth offense), driving with alcohol in her system while her license was suspended, and habitual offenders.
