The trial of Justin Libengood was scheduled to get underway tomorrow, but Indiana County President Judge William Martin last week granted a defense request for a continuance.
Libengood is charged with aggravated assault, prohibited possession of a firearm, attempted robbery, and criminal discharge of a firearm into an occupied structure. He was involved in a shooting at the Days Inn in Burrell Township on July 1st last year. State police say he met David McGinnis of Bolivar inside a room at the hotel, pulled a handgun and tried to rob him. The two struggled over the gun and a shot was fired, grazing McGinnis in the back of the neck. The two fled the hotel and were later captured. Matraca Vrana of Northern Cambria was in the room with the two men. She stayed after they fled and was later charged with drug offenses. Her case has since been adjudicated.
Judge Martin has rescheduled Libengood’s trial for March 23rd.
The case against McGinnis is scheduled for Criminal Call on March 6th. He is charged with possession with intent to deliver and, in separate cases, also faces serious drug charges in Westmoreland County.
