In Indiana County Court today a number of criminal defendants are scheduled for sentencing, including 23-year-old Jacob James Wissinger of Creekside Road, Indiana. He pleaded guilty to misdemeanor indecent assault forcible compulsion, with agreement for non-prosecution on felony charges of aggravated indecent assault and strangulation, and misdemeanor indecent assault without consent.
The incident happened at a woman’s apartment on Grant Street after Wissinger asked if he could stay with her rather than drive home intoxicated on February 15th. The woman told police that she was assaulted briefly before Wissinger fell asleep, but he later woke up and assaulted her sexually again. He’s been evaluated by the Megan’s Law Sexual Offender Board, and their assessment will be part of the sentencing today.
Also scheduled for sentencing is 38-year-old Timothy Maxwell Butterworth of Punxsutawney, who was caught in the act of burglarizing the home of an elderly couple living along Route 210 in North Mahoning Township last December. He pleaded guilty to felony burglary and criminal trespass. He confronted police when they responded and was tasered before being taken into custody. Charges related to that confrontation and an additional charge of terroristic threats will not be prosecuted.
Other defendants on the sentencing docket today include:
- 63-year-old John Randy Cozy of Indiana, for child pornography.
- 52-year-old William Eric Hodge of Indiana, for possession of a controlled substance.
- 27-year-old Dalton Lee McClain of Greensburg, for recklessly endangering another person.
- 64-year-old Charles Hilty of Homer City, for simple assault.
- And 35-year-old Misti Lee Durante of Indiana, for felony possession with intent to deliver a controlled substance. She is also subject to three probation revocation hearings.
