The State Supreme Court has asked a lower court to consider if a Greensburg Woman should be re-sentenced in connection with the death of a mentally disabled woman that the suspect is accused of torturing and killing.
Reports say Angela Marinucci will head back to state suprerior court where an appeal challenging Marinucci’s life sentence will be heard. Marinucci was sentenced in 2015 to life in prison for first-degree murder in the death of Jennifer Daughtry of Mt. Pleasant back in 2010. Daughtry was held captive for over 2 days, and was beaten and tortured before she was eventually killed. Her body was then bound in Christmas Lights and put in a trash can. The can was later deposited in a parking lot.
Marinucci was 17 at the time of her arrest, but since then, State and Federal appeal courts have ruled that mandatory life sentences for juveniles are unconstitutional. A re-sentencing hearing was held in 2015, with lawyers representing Marinucci trying to get the possibility of parole installed, but a judge said that a life without parole sentence was still warranted.
Co-defendants in the case, 30-year-old Ricky Smyrnes and 27-year-old Melvin Knight, were sentenced to death, but Knight’s sentence was vacated by state appeals court. He returns to court for a new sentencing trial.
