The homicide trial of 21-year-old Nathanial Price was to begin today in Indiana County Court – and in fact is still listed on today’s court schedule – but both the prosecution and the defense are already seeking appeals in the case.
Price is one of two men accused of killing a Cherryhill Township couple during a marijuana deal in October of 2016. Investigators say they jumped 26-year-old Timothy Gardner in the foyer of the home and beat him to death, then either Price of Justin Stevenson went upstairs and killed 20-year-old Jacqueline Brink because she would have been a witness to the crime.
Last Tuesday, Price’s attorney filed a petition asking for permission to file before State Supreme Court an interlocutory appeal and an application for a stay of his trial. Then on Thursday, Assistant District Attorney Gina Ryen Force filed a notice of appeal to State Superior Court.
Stevenson has already pleaded guilty to two counts of second degree murder and is serving life in prison without parole. In May, he filed notice of intent to file a petition for post-conviction collateral relief and has asked for and been granted a series of continuances since that time, including one last week.
