In Indiana County Court yesterday, District Attorney Pat Dougherty filed a brief opposing an omnibus pretrial motion for relief being sought by the attorney for 21-year-old Joseph Popovich of Homer City.
Popovich is charged with homicide by vehicle, homicide by vehicle while driving under the influence, and related offenses in the death of 16-year-old Kai Hrabovsky of Homer City on May 14th last year along Mount Zion Road in Pine Township. Hrabovsky and some friends were walking along the road at 3:35 AM when, according to police, Popovich’s Jeep struck the Homer Center High School student.
The motion for relief filed in February could cover a number of considerations, including the suppression of evidence, which in turn could make the case more difficult to prosecute.
Popovich is currently listed for Criminal Call on August 4th.
