Campaign officials for a former hedge fund manager running for the Republican nomination U.S. Senate are asking the Pennsylvania Supreme Court to take over a legal battle as to whether mail in ballots that do not have a hand-written date on them should be counted.
Reports say that that Dave McCormick continues to trail former TV personality Dr. Mehmet Oz by less than 1,000 votes in the race for the nomination. The state department has said that if the margin remains within a half a percentage point, an automatic recount will be triggered at the state level.
McCormick filed the request to the State Supreme Court after he had filed a similar request at the commonwealth court level for an “Application for emergency relief” and a “motion for immediate special injunction and supporting memorandum of law” to count the ballots that do not contain a handwritten date on them. On Monday, McCormick filed a suit on Monday to have the ballots that arrived on-time but did not have a handwritten date counted in the final total. McCormick’s legal counsel said that because the ballots are stamped with a date on them, the handwritten date is meaningless.
The Department of State instructed all Pennsylvania counties to tally the no-date ballots but to keep them separate and not add them to the final totals yet.
