The case against former IUP student Brady Distefano is back on the active list in Indiana County Court, and is listed for Criminal Call on January 4th.
The 21-year-old Distefano is charged with aggravated assault in connection with the death of a fraternity brother in February of 2017. He was originally charged with criminal homicide and aggravated assault in the killing of 20-year-old Caleb Zweig of Rockville, Maryland, but in November of last year, Indiana County President Judge William Martin dismissed the charges, ruling that there was not sufficient evidence that DiStefano had caused Zweig’s death. District Attorney Pat Dougherty appealed to Superior Court, which in October ruled that Martin was correct in dismissing the homicide charge, but that it could be reasonably inferred that DiStefano knocked Zweig down in a fight and “pounced” on him, continuing their altercation until he was pulled off Zweig by a third man. Trevor King was walking in front of DiStefano and Zweig in the 800 block of Wayne Avenue and heard the two scuffling. He turned around to see DiStefano already on top of Zweig on the ground.
Zweig died at the Indiana Regional Medical Center hours after the fight.
