Pennsylvania’s mail-in voting law has been ruled unconstitutional by Commonwealth Court.
The General Assembly approved legislation which was signed into law by Governor Tom Wolf in 2019 to allow mail-in voting. But the court ruled the State Constitution must be amended in order for mail-in voting to continue. In a statement Senate President Pro Tem and Republican candidate for governor Jake Corman said because of concerns with the way the law was implemented by the Department of State, he has no confidence in the mail-in ballot provisions. Corman added that the “ruling should serve as a call to action to open up a serious conversation about the reforms necessary to make voting both accessible and secure for all Pennsylvanians.”
The governor said his office will immediately file an appeal to the State Supreme Court, and criticized the Republican-controlled legislature which passed the act for now taking it away “in the service of the Big Lie.” The statement continued that the strength of democracy and the nation depends on eligible voters being able to cast their ballots.
Act 77 will remain in place, pending a final decision on the appeal.
