Many of the court proceedings at the Indiana County Courthouse today are plea and sentencing hearings for DUI cases. But one case on the schedule involves a man convicted of killing a Blairsville Dentist in April of 2006.
Court documents today show an nunc pro tunc appeal hearing is on the schedule today for Kevin Foley. He is currently serving a sentence of life in prison without parole for the murder of Dr. John Yelenic. In 2017, Foley appealed the case before the state supreme court, saying that then-President Judge William Martin should not have allowed jurors to hear testimony about bloody footprints found near the victim’s body. The court also affirmed DNA evidence collected under Yelenic’s fingernails and other pieces of proof linked Foley to the crime.
An appeal nunc pro tunc is a petition asking the court permit a party to file an appeal after the standard legal deadline has expired. If granted, the court would treat the appeal as if it was filed on time.
