The Pennsylvania Superior Court has upheld a ruling transferring the homicide case of a Clearfield County teenager accused of fatally shooting a 12-year-old girl from adult criminal court to juvenile court.
According to WJAC News, The court said a trial judge properly considered factors under the state’s Juvenile Act, including expert testimony that the 14-year-old did not act with malice and is amenable to rehabilitation. Prosecutors argued the case should remain in adult court, but judges found no evidence the shooting was premeditated and ruled the transfer decision was not invalidated by a court-related delay.
The case will now proceed in Clearfield County Juvenile Court.
