UPDATE: Both Jacob Gallagher-Luterman and Matthew Balzer waived their preliminary hearings. Their cases will now head to the county Court of Common Pleas.
WHAT WE FIRST REPORTED
Two men charged with trying to force their way into an off-campus multi-tenant property last month are due in court today for a preliminary hearing.
Indiana Borough Police charged 20-year-old Jacob Gallagher-Luterman of Allison Park and 21-year-old Matthew Balzer of Etna with simple assault, criminal trespass and disorderly conduct in connection with the incident early in the morning of October 24th, while Gallagher-Luterman faces additional charges of terroristic threats, possession of an instrument of crime, and underage drinking. Police were sent to the 200 block of Rice Avenue at 2:05 AM for the reported disturbance and found a group of college-aged people gathered outside while two men were trying to force their way into the building. Punches were thrown in the incident and one of the men reportedly displayed a handgun while making threats. One of the suspects was seen nearby and fled the scene. A BB gun that resembled a handgun was near where one of the suspects was.
Both were free after posting bail and will be before District Judge Christopher Welch today.
