The attorney for Kevin Foley on Thursday filed a brief in opposition to the prosecution’s motion to dismiss Foley’s petition for relief from his murder conviction in the 2006 death of Blairsville dentist John Yelenic.
The 60-year-old Foley, a former state trooper, was found guilty in 2009. He had expressed his hatred for Yelenic, who was in the process of divorcing his wife, with whom Foley was living at the time of the killing.
Foley’s conviction was upheld by State Superior Court in 2012 and re-affirmed by the Supreme Court in 2017. He’s serving life in prison at SCI Mahanoy in Schuylkill County. Judge Thomas Bianco scheduled arguments on the issue for September 30th.
