State lawmakers are taking a stand against “squatters” by introducing legislation that protects legitimate homeowners in Pennsylvania.
Senator Joe Pittman said Senate Bill 1236 defines what constitutes as a “tenant,” simplifies the reclamation process for homes, and addresses squatter concerns in the state. A “squatter” is someone who unlawfully occupies an uninhabited building or home and they may only take possession through adverse possession if they can prove all elements of their claim for jurisdiction where a property is located.
Under current Pennsylvania law, squatters are considered trespassers after the property owner tells them to leave their property. If they aren’t told, they would need a “notice to quit” to be issued to individuals who have no legal right to a property. In short, it puts home and landowners in financial and emotional binds.
The bill now heads to the House.
