A man from Derry Borough is currently in Westmoreland County Prison awaiting trial on charges of rape, aggravated assault, terroristic threats, unlawful restraint and other crimes for an incident in November.
55-year-old Richard C. McElhenny was arraigned on Wednesday on those charges. On November 8th, police say the victim reported to them that she had been sexually assaulted overnight in the basement of a home in the borough. Mcelhenny allegedly bound her hands and ankles and threatened her with a knife. He left the scene after cleaning up and burning something outside. Investigators were able to collect evidence at the scene.
Attorney Phil DiLucente said he was surprised that bail was denied in the case. He said that this is not a murder case and hopes to have bail adjusted at the preliminary hearing.
