The attorney for Clayton Mibroda on Thursday filed a memorandum of law to support his client’s petition for post-conviction relief of a 2013 guilty verdict for the death of his newborn baby girl.
Mibroda, who is from Bolivar, is serving 30 years in prison for the shaking death of 20-day-old Natalee Mibroda on December 27th of 2011. Mibroda has claimed all along that the baby’s mother, Kayla Lichtenfels, shook the baby, causing the injuries that led to her death.
Attorney Tim Andrews claims in the appeal that the testimony of Brandon Green of Black Lick, Indiana County, proves that Lichtenfels confessed to Green that she had done it. However, prosecutors say Green is not a credible witness, pointing to his claim that he was visited in the Indiana County Jail last year by two men, possibly private investigators, who talked to him about the case. Jail records do not include any mention of visitors to Green at that time.
Attorneys for both sides were ordered to submit briefs during a hearing last month. The prosecution has yet to do so.
