The Indiana County Court case against David McGinnis is now listed as closed, while his cases in Westmoreland County remain on course for trials in the fall.
The 27-year-old Bolivar man was facing Indiana County charges of possession with intent to deliver, recklessly endangering another person, discharge of a firearm into an occupied structure, and prohibited possession of a firearm. Last week, the district attorney declined to prosecute the drug charge, and the other charges had been previously dropped at the District Court level.
McGinnis was charged last July after a shooting at the Days Inn in Burrell Township. He and another defendant, Justin Libengood, tussled after police say Libengood pulled a gun and attempted to rob McGinnis during a drug deal. A shot was fired and grazed McGinnis in the neck.
Libengood is scheduled for trial August 25th on charges of aggravated assault, attempted robbery, discharge of a firearm into an occupied structure, and prohibited possession of a firearm.
David McGinnis has four trials scheduled in Westmoreland County…on September 21st, he is scheduled for trial in an intimidation of a witness case and a separate contraband case for crimes committed while he was in prison. On October 5th, he is scheduled for two drug trials.
