UPDATE: David Oswalt, Sr., was sentenced to five to 10 years in state prison on a count of involuntary deviate sexual intercourse, two to 10 years for incest and one to two years for corruption of minors. All the jail time will run concurrently.
Eric Flanary was ordered to serve nine months to a day less than two years in Indiana County Jail each for three counts of burglary, escape, theft by unlawful taking, and reckless burning. A sentence for 2-12 months in jail on a charge of criminal mischief was immediately paroled. All the jail time will run concurrently.
WHAT WE PREVIOUSLY REPORTED:
Two defendants are scheduled for sentencing today in Indiana County Court, including a man who admitted having sexual relations with a teenage girl.
57-year-old David Oswalt Sr. of Clymer pleaded guilty in January to indecent assault of a person less than sixteen years of age, incest, and corruption of minors. He was charged with 92 criminal offenses, including seventy-two felonies.
Police began investigating last July when alerted by Indiana County Children & Youth Services, which notified Indiana Borough Police of alarming text messages sent and received by the victim, who was 15 years old. Borough Police worked with CYS, the District Attorney’s office, investigators from the Department of Homeland Security and agents from the FBI, who were able to unlock the girl’s phone and read more texts after she had become uncooperative. Oswalt was charged in October and eventually admitted having relations with the girl between five and ten times. He paid her because, as he told police, he had what she wanted – money – and she had what he wanted – sex.
Oswalt’s sentencing today will also include the results of a Megan’s Law assessment to determine if he is a sexual predator.
The second defendant to be sentenced today is 24-year-old Eric Flanary of Wheeling, West Virginia, who pleaded guilty to three counts of burglary, two counts each of theft, reckless burning, and criminal mischief, and one count of escape.
Flanary escaped from police last October as he was being handcuffed for domestic assault at the home of his girlfriend at a home in Armstrong Township. He ran into the woods and was later located in a garage along Trim Tree Road after he set small fires in a shed and a barn in order to keep warm. He’d also attempted to take an electric bicycle to aid in his escape.
Both Oswalt and Flanary will be sentenced before Judge Thomas Bianco.
