There is a motions hearing scheduled today for Justin Libengood, the Latrobe man charged with trying to rob another man during a drug transaction, resulting in gunfire last July at the Days Inn in Burrell Township.
Libengood, who will turn 31 years old on Friday, is charged with aggravated assault, prohibited possession of a firearm, attempted robbery, and criminal discharge of a firearm into an occupied structure.
Investigators say the shooting happened July 1st after he met David McGinnis of Bolivar inside a room at the hotel, pulled a handgun and tried to rob him. The two struggled over the gun and a shot was fired, grazing McGinnis in the back of the neck. Both men then fled the hotel and were later captured.
Matraca Vrana of Northern Cambria was in the room when the incident occurred. She stayed after Libengood and McGinnis fled and was later charged with drug offenses. Her case has since been adjudicated.
Libengood’s trial is scheduled for June 8th. McGinnis is charged with possession with intent to deliver a controlled substance and is scheduled for Criminal Call on June 2nd in Indiana County. He faces two more serious drug cases in Westmoreland County and is scheduled for trial there on June 1st.
