There is a motions hearing scheduled today for 30-year-old Justin Libengood, the Latrobe man involved in a shooting last year at the Days Inn in Burrell Township, but the hearing is unlikely to happen. The prosecution yesterday asked for a continuance.
Police say Libengood pulled a gun and tried to rob David Lee McGinnis of Bolivar inside a hotel room. The two fought and a shot was fired, with McGinnis suffering a wound to the back of his neck.
Libengood is charged with aggravated assault, prohibited possession of a firearm, attempted robbery, and criminal discharge of a firearm into an occupied structure.
Libengood’s hearing remains on today’s schedule, but the motion for continuance, if granted, would push it to a later date, and would also postpone Monday’s scheduled trial date back. McGinnis is charged with possession with intent to deliver a controlled substance. His case remains in the Indiana County Court system, and he faces two drug cases in Westmoreland County.
In another case in Indiana County’s courts, the preliminary hearing for 25-year-old Matthew Bartlebaugh of Glen Campbell was to have been held today, but has been continued to April 30th. Bartlebaugh is charged with criminal homicide, aggravated assault with a deadly weapon, and recklessly endangering another person in the shooting death on New Year’s Day this year of his father, 43-year-old Jerald Bartlebaugh, who was shot to death as he slept in his bed at Graham and Morris streets in Glen Campbell.
The hearing April 30th will be held before Magisterial District Judge Guy Haberl.
