The Center Township Supervisors gave an update on the legal process concerning the township and John and Rosemary Bertolino.
Last October, District Judge Susanne Stefee ordered that the Bertolinos should pay fines and court costs in connection with a ordinance violation concerning a garage built on a private alley without a building permit. They appealed the ruling and a hearing was set for February 25th. On the day of the hearing, Supervisors Chairman Dave “Butch” Smyers said that they were prepared to present evidence that the Bertolinos had violated the township ordinance, but new evidence was presented.
The hearing was continued to give the supervisors a chance to review the The day after that hearing, Smyers said that the Bertolinos filed a new building permit application along with a drawing that showed that the private alley is now on their property. The supervisors will request their solicitor to determine whether the new property acquisition puts the garage entirely on the Bertolino property and in compliance with the ordinances. A vote on the permit application will take place at the next monthly meeting in April.
