The murder trial of Nathan Price has not yet been scheduled, but the case is moving forward. Yesterday, the Indiana County District Attorney’s office filed a response to a motion by Price’s attorneys to forbid the prosecution from pursuing the death sentence.
Price just turned 20 years a week ago. He and 20-year-old Justin Stevenson are accused of beating to death Timothy Gardner and Jacqueline Brink at the couple’s apartment in Cherryhill Township in October of 2016.
At a status conference last month, Judge Thomas Bianco scheduled an evidentiary hearing to take testimony and evidence regarding an omnibus motion for relief, which would basically end the case against Price, and the motion to preclude the prosecution from seeking the death penalty. The judge also said he intends to close the record on those motions at the conclusion of that hearing.
The next deadline in the criminal proceedings against Price is Monday, when D.A. Pat Dougherty must provide the defense with a report by his expert witnesses, if he intends to use any.
Price is due for Criminal Call on October 5th. Stevenson’s Criminal Call is scheduled for September 7th.
