In Indiana County Court today, Judge Thomas Bianco will resume motions hearings that were continued last month for 35-year-old Keon Clark of Rochester Mills. Clark is facing charges in two cases from last year, one from a drug sweep that netted 26 suspects in Jefferson County and northern Indiana County, and the other for drug offenses committed while in custody.
In total, he’s charged with two counts of possession with intent to deliver, criminal use of a communication facility, possession of a controlled substance/contraband by an inmate, and possession of a controlled substance. Clark also faces drug charges in Jefferson County.
At the hearings last month, Judge Bianco noted that the prosecution had provided the defense with a DVD containing all of the photos and information requested in the defense motion, and said the defense may renew the motion of there’s anything missing. He also ordered the prosecution to provide photos of Clark’s prison clothing or to allow the defense to inspect the clothing itself, and he kept the record open on additional proceedings, including a Writ of Habeas Corpus.
Bianco will set a briefing schedule at the conclusion of today’s hearings.
Judge Bianco will also conduct a motions hearing in another drug case, this one involving 23-year-old Zachary Woznichak, an IUP student from McKees Rocks who was caught with 3-and-a-half pounds of marijuana in a duffel bag in his car during a traffic stop on Water Street in Indiana in March of last year. Borough police also found $1,500 cash in the car. The estimated street value of the pot was $23,800.
