With his appeal of his murder conviction pending before State Superior Court, 61-year-old Richard McAnulty has been given until January 11th to notify Westmoreland County Court Judge Richard McCormick Jr. of the precise errors he believes the court made in his original case. Meanwhile, Superior Court yesterday posted the appeal, which was filed December 20th, and also noted that McAnulty has applied for pauper’s status, which if granted would permit him to have legal representation appointed for him.
Judge McCormick last month denied McAnulty’s petition for post conviction relief.
McAnulty shot 39-year-old Harry Mears III in July of 2010. Mears and McAnulty’s wife had been involved in an extramarital affair that had ended months before, but McAnulty discovered emails between the two and became enraged, driving thirty miles to Mears’ home to kill him.
In his petition for relief, McAnulty claimed his original attorney botched the defense and that Judge Debra Pezze should have not allowed Diane McAnulty to testimony about the emails. Judge Pezze passed away last year.
In his latest ruling, Judge McCormick informed McAnulty that only the specific legal issues he raises will be considered in the appeal to Superior Court.
McAnulty is serving life in prison without the chance for parole.
