Checking the progress of the Richard McAnulty murder case today…the Westmoreland County district attorney has filed a court brief opposing the petition for post collateral relief, which McAnulty’s attorney is pursuing in an effort to overturn his conviction.
McAnulty is the Center Township man who, in July of 2010, drove from his home to Southwest Greensburg and shot to death 39-year-old Harry Mears III, who had been involved in an extramarital affair with McAnulty’s wife. The affair had ended months before, but McAnulty had discovered emails between his wife and Mears and had become enraged, driving thirty miles to Mears’ home and killing him.
McAnulty claims his former attorney botched his defense. Two weeks ago, Judge Richard McCormick Jr. declared the case record reopened and allowed the defense to use the transcript of the portion of the trial in which Judge Debra Pezze allowed the testimony of Diane McAnulty about the emails.
D.A. John Peck’s brief in opposition to the reopening of the case was filed last Tuesday. The docket sheet does not list the next court action. Judge Pezze, who presided over the original trial, passed away last year.
McAnulty was convicted of first degree murder and sentenced to life in state prison.
