In Westmoreland County Court, new motions have been filed on behalf of Ty Holler, a 24-year-old former volunteer IUP football coach who is charged with sending sexual texts to two Mount Pleasant High School football players in 2014 and 2015 and asking for similar sexual texts in return.
Holler’s attorney has filed a Writ of Habeas Corpus on a charge of communication with a minor for sexual abuse. Attorney Michael David Ferguson has also filed a motion for suppression of statements on charges of hiring or permitting a minor to assist in producing or distributing sexual materials. And he’s filed a motion for discovery on charges of corruption of minors.
Investigators say Holler texted the boys, who were 15 and 16 years old at the time, telling them about his sex life at IUP and asking for details about their sexual exploits. He’s also accused of sending the boys pictures of a topless woman and telling them she wanted to be with them if they would reply with explicit pictures of themselves.
Holler contends that a former girlfriend sent the texts while he was sleeping and that he no longer has her contact information. He testified at his preliminary hearing that he and the woman met the older boy at a bar near IUP and the boy later sent an unsolicited nude photo of himself and a video of himself having relations with a girl.
Holler is scheduled for trial on November 13th. Judge Rita Hathaway ordered that his case be scheduled for the next available Westmoreland County Criminal Motions Court.
