After one of his co-defendants this week was granted an extension of time to file pretrial motions, 19-year-old Nathan Price has filed for the same consideration as he prepares to face trial for murder.
Price, 20-year-old Justin Stevenson, and 18-year-old Isaiah Scott are charged in the beating deaths of Timothy Gardner and Jackie Brink last October at the couple’s home
Along Hillside Drive, outside of Clymer in Cherryhill Township.
Judge Thomas Bianco on Tuesday granted Stevenson’s motion for an extension, giving him until August 25th to file his pretrial motions, and pushing Stevenson’s Criminal Call appearance to October 6th.
Price and Stevenson had both been scheduled today for hearings on motions to appoint a separate attorney for the penalty phase of their trials and for pauper’s status. Those hearings have been postponed. D.A. Pat Dougherty is seeking the death penalty against both of them.
Isaiah Scott was 17 at the time of the killings and is therefore ineligible for the death penalty. Charged as an adult, he has a hearing scheduled August 16th on a petition to move his trial to juvenile court.
