Some behind the scenes court action has been going on in the Joseph Popovich homicide by vehicle case. Popovich is the 21-year-old Homer City man accused of causing the death of 16-year-old Kai Hrabvosky of Homer City. Investigators say Hrabovsky was struck by Popovich’s Jeep while walking alongside Mount Zion Road at about 3:35 AM on May 14th last year in Pine Township.
In February, defense attorney Taylor Malcolm Johnson filed an omnibus pretrial motion for relief, which could include a number of considerations, including suppression of evidence. Last week, District Attorney Pat Dougherty filed a brief in opposition to that relief and a DuBois attorney working for the defense filed a brief in support of it.
On Wednesday of this week, attorney Johnson filed another motion, asking for another continuance of Popovich’s Criminal Call, which is scheduled for August 4th. The court has not scheduled a hearing date on the motion for relief, nor ruled on the motion for continuance.
