42-year-old Larry Plovestsky of Black Lick is on today’s Criminal Call list in Indiana County Court, but recent court action may forestall that proceeding. Plovetsky is charged with homicide by vehicle and related offenses for an accident that took the life of 80-year-old Clara Santus of Black Lick in November 2015.
Last month, Judge William Martin granted a defense request to suppress the evidence of Plovestky’s blood draw, which imperils an additional charge of homicide by vehicle while driving under the influence. There were procedural problems with the blood evidence and with a form that Plovetsky signed. The blood draw turned up evidence of marijuana, but it could have been in his system for days before the crash.
On Monday, District Attorney Pat Dougherty appealed to State Superior Court, asking for a reversal of Judge Martin’s decision to suppress the evidence of the blood draw. On Wednesday, Martin gave the D.A. twenty-one days to file a concise statement on the information in the appeal.
There is a pretrial motions conference scheduled for Monday morning.
